On this episode of With A Voice Like This:

Well, I had something to give away and it was the Eats Paste EP from Toy Block Music which is available throught the website starting 1 April. And don’t forget that a portion of the proceeds from the sale of the EP go to Pager to help with infant reflux disease.

But before I drew and announced the winner (yes, delayed gratification is the keyword here) I did a follow up with some additional information from last week’s show, regarding ReverbNation,  Audiolife (ReverbNation’s  partner in the Reverb Store)  and CD Baby.

And now to the big news. I had quite a few entries to win the the free download code for Eats Paste and I wish I had enough codes for everyone who entered, but  I only had one. And the winner was April. Congratulations and I’ve sent you your code via e-mail and the EP will be available for download on the Toy block Music website starting Thursday, 1 April. This episode of With A Voice Like This is a very special interview with Joanna Quargnali-Linsley of Toy Block Music and Misery Loves Co. about the March 4th preview of the EP Eats Paste to be released April 1st of this year.

Joanna tells us about the overall project and how it came about, how the charity Pager was chosen to receive a portion of the profits from the sale of the EP and some of the different experiences. A few of the artists who appear on the EP called in as well to talk about their part in the process (as well as tell a few stories) and best of all? This episode of With A Voice Like This is all about the New Music Seminar that was held in Chicago on October 6, 2009 and it’s founder Tom Silverman. I’d like to thank Ariel Hyatt of Ariel Publicity and CyberPR for providing me with the opportunity talk with Tom Silverman during the Seminar.

I’m presenting the interview in its entirety in the show because I think it’s very important to hear it directly from Tom, but there are quality issues with the audio. Because of that, I have transcribed the interview and put it here in the show notes or you can download the transcript of the Interview in PDF format so you have it as you listen. There’s a lot of great information there, I hope you enjoy the interview as much as I did.

Transcript of the Interview with Tom Silverman

Jim Goodrich: I’m here with Tom Silverman, the founder of Tommy Boy Records and the New Music Seminar. First, I wanted to thank you for taking the time to talk with me. You started the New Music Seminars back in the Eighties and then for awhile it was dormant for about fifteen years or so, is that correct?

Tom Silverman: Exactly.

JG: What was the compelling factor to bring the New Music Seminars back?

TS: They…Just had a revelation about where the business was going and where the business wasn’t going and I thought it was time for us to do something about it, so that we can have a forum to discuss this. I go to so many conferences around the world and nobody’s talking about what we talk about here. Nobody’s talking about what’s going to happen next, nobody’s talking about what artists need to do and how artists can help establish themselves in this difficult world. Uh, everyone’s talking about label problems and label problems are almost irrelevant.

JG: Then the basic reason you’re doing this is you’re seeing it move more toward the DIY side, the Do It Yourself side. Is there going to be a place for a crossover, or do you see the labels becoming completely irrelevant and so you have to become your own everything, basically?

TS: No, I don’t think artists are going to be able to become their own everything just [be]cause recording, writing songs, recording and you know, touring and blogging and tweeting and the other things that artists have to do are all they can possibly do. I think that somebody has to handle all of the other stuff and it’s a long list of other things and that could be a manager, it could be a label or it could be services company, you can call it whatever you want to call it, but somebody has to do that. It could be ten different companies that do all the ten different things or it could be one company that calls themselves a label, but a label has to do, will have to do different things than they do now.

They’ll have to be involved in helping to develop and manage the relationship between artists and their fans and helping them best monetize that. And in exchange for that, they’ll get a share of that monetization depending on what deal they cut. Based on where the artist starts, you know and where they are in their career would depend on what that deal is. And the concept of how those deals will evolve is just in its infancy now because nobody’s even thinking that way. Everything is still album centric.

JG: I would think that you would feel that this is what the New Music Seminars is all about. How do you see this progressing, its role in doing this? Right now it seems to be that the role of New Music Seminars is to get people talking about it. Do you see the New Music Seminars growing into even more than that?

TS: Yes. I would like to think so, but I think we’re still a little ways away from it. As we get a little bit more clarity and all, and we get a little bit more momentum, they could turn into a lot more than that. They can actually turn into an active force for helping find the artists most on the verge of breaking. I believe there’s probably hundreds of artists that are stuck in the glut of releases, the hundred and five thousand albums that come out every year that can’t break through, even though they’re deservant of it. I believe there are Elvis’ and Beatles’ that are being stuck, that can’t get through because there’s not…The economic engine that used to go find them is going away, so nobody’s really looking there anymore and nobody’s helping pull those artists out, but…And some of those artists are getting somewhere with Pitchfork and other things on the web to a certain level, but they need help going beyond that and there’s nobody really there to help them. So we want to be, um, ones to help them and hopefully we can put together new technologies and, and new economic models that will help artists break out of that glut and break through.

It’s the great failure of the Internet; everybody talks about the Internet as the greatest things for artists and for consumers because it’s so democratic, anyone can put a record out able to make a record now. So, you know this year there will probably be a hundred and twenty thousand, up from a hundred and five thousand, up from seventy nine [thousand] the year before, up from twenty two thousand in 1992. So, where are we going with this? They predict three hundred thousand releases a year, like books. You know, that’s not necessarily a good thing for consumers. Especially with seventeen thousand of the albums that came out last year only sold one copy. Seventy thousand of them didn’t sell a hundred copies. So you’re really talking about um, a noise floor of just, you know, insects and gnats that may mean nothing, but still get in the way of legitimate artists from breaking through.

Once an artist gets beyond ten thousand and only two hundred did that last year for the first time or less, um, then they’re in a little different environment because there’re so few that get there. So now you’re only amongst a small group of two hundred. And some of them go on to sell half a million and some of them maybe only go on to sell twelve thousand. But even if they sell twelve thousand and they do all the things we’re talking about here to monetize their fan relationship, they can earn a great living. So all…Anybody who gets beyond ten thousand albums in this day and age can um, can quit their day job and you know, be rescued from the sea of obscurity. But, you can even be uh, quit your day job below ten thousand, we talked about some examples today of artists who don’t even sell that many, but are able to monetize their fan relationship enough that they can do this full time.

JG: From the, the seminar that we had today here in Chicago, what do you think is the top one or two takeaways that the people who’ve been attending should really come away with from here?

TS: Well, there’s two kinds of people that attend, there’s artists and then there’s all the people who serve the artists. As I said in the beginning, artists serve fans and everyone else serves the artists. So, the people…From the artists, they have to understand that it’s not going to happen by itself and that quantum events, uh, hoping that they’re going to win the lottery is probably not a good strategy. Putting together a strategic approach to growing their business and looking at what they do as a business, to find and build fans and differentiate themselves from the competition, identify ways that they become successful, in redefining their success, that’s what they can come away with. A new definition of success, a different paradigm for what the business, what business means today.

And then for the people on the other side, the business side, they have to look at the new paradigm too. How can we better serve the artist community in a world where we’re not record-centric anymore. Records may be part of it, but that part is going to diminish and however we monetize music, or don’t monetize music, we monetize fan relationships, so how do we do that? You know and what’s the meaning of a song in that world. Everything changes, so it’s so really hard when you come from a past mentality, almost everybody that’s in it worked at a record company before or has, brings baggage with them, mental baggage that they have to release. And the seminar is about trying to knock them out of that baggage and change the new paradigm. And it’s so funny, you talk with all these artists about this and then at the end of the day, they all come up and give me CDs to try to get me to sign them again anyways. [laughter] It’s a, it’s an interesting thing.

JG: To sort of bring this two together, you talked about the Internet and being more democratic, but not being everything that, that they need, so it’s not just the Internet, it’s not just the old school, the legacy system that’s been there, is it an amalgamation of all this?

TS: It’s not the Internet for two reasons. One, it creates more noise and two, it…People use the Internet as a filter to not hear anything they don’t want to hear and only hear the things they’re comfortable with. Whereas traditional Radio, people had to hear music they didn’t like the first spin, the second spin and then it grew on them. Nobody ever lets music grow on them on the Web, because if you don’t like it in twenty seconds, bang! You’re on to the next thing. See the Atlantic Monthly article from last year Does Google Make Us Stupid? It’s, you know with, you know, our time span is shorter.

I mean, I like to have a discussion with creative panelists “what about making songs, an album of songs that are ninety second long”? Let’s say “Okay, here’s a new genre, it’s like haiku for songs”. You know, you have ninety seconds to make your statement. Which is great because I could listen to ten times more songs that are ninety seconds long than are five minutes long. And I want to listen to a lot of songs. And guess what? If I like the ninety second songs maybe then I’ll buy the four minute version. And for four minutes maybe I’ll pay, maybe I should pay ninety-nine cents for an iTunes download of my ninety second song. If you want the four ninety-nine…You know four minute version you have to pay you know, $2.99 for that version. If you want the album it’s $9.99, you know? We can have all different pricing models. Or, it may all be free anyway. Maybe we give away the ninety second version and let them buy the four minute version.

Really, people don’t have that much time anymore; they’re used to getting things fast. You know, we talked about it in one of the Movements about a, a Flash intro. Nobody waits for a Flash intro. You see a Flash intro, if you can’t skip it, you even leave. It’s too late. So, you know, people want to get to the point and want to get there fast, you know. Google has taught us we have to find what we want and we get ‘X’ amount of keystrokes in ‘X’ amount of seconds to get there. If we don’t get there, we’re on to something else. So you know we have to make it quicker, we have to make it easier for people to buy music from you, for people to discover music. That’s something that the technology side has to improve. They have to be able to uh, do better uh, search. They have to do better uh, affinity engines, ways uh, you know uh, ways to, to track consumers’ tastes. We were talking about “scrobbling” earlier. So, Technology has their assignment, artists have their assignment and the music business that serves the artists has their assignment.

And we talk about all three of those areas here at the seminar. And we do it in a positive way uh, not trying to point fingers or complain, but we say this is the work that we have to do. And these are the opportunities because the people who get it right, whether they be artists or, or music business people, or technology people, they’ll become very rich. If they get it right.

JG: I don’t want to take up too much of your time and I, I think you’ve answered all the questions that I had. Thank you very much for, for letting me talk to you.

• A few minor (but important) victories for YouTube in their class action suit  charging them with copyright infringement as seen in the cnet article. This doesn’t affect the Viacomm suit suit brought against YouTube directly, but does clear some of the infringement claims made.
• A Revisit to the Usenet issue. A member of the Podcast Gallery alerted me to the fact that AT&T was shutting off access to Usenet from their services on or around July 15 in this CrunchGear article. While in my opinion the article makes use of a little fact and a lot of fertilizer, it does let you know what’s happening with Usenet.

• I’ve talked about the new set we’ve put together. We’ve rehearsed it and we decided we’re ready to just get out there and kick the tires on this set. so we’re currently looking for a place to perform this set and we’re hoping it will be soon, so keep an eye out here or at 4-AM.net and you’ll know about it as soon as we do.
• This isn’t 4-AM specific, but a few shows back I talked about the difference between Facebook pages and groups and said that I had a 4-AM Facebook page and switched my With A Voice Like This group to a page. And wouldn’t you know it, just after I did all the switching, they’re changing up how pages work. So I talk a little about it.

• I got an e-mail forwarded to me  from the Chicago National Academy of Recording Arts and Sciences (NARAS, think Grammy) about the Performance Right Act on which Congress is currently holding hearings. I hadn’t had the time yet to look at it much, but it’s all about legislating terrestrial radio to pay for playing music on air. I know I’ll be discussing it in a future show, hopefully with some guests, but you can get a jump start on the topic at Grammy.com/musicfirst.

…Why White Space gives me a headache

If you’re a musician or a speaker, or an actor, or a presenter and you use a wireless microphone system or wireless personal monitors (in ear) or a wireless guitar pickup and you don’t know whether or not it operates in the 700 MHz spectrum (698 – 806 MHz to be exact), you need to. You need to stop what you’re doing and check. You see, manufacturers aren’t making those systems in that range anymore and sooner rather than later, using that spectrum will be considered illegal. I know, tough language and a bit dramatic, but a real issue. The FCC has reallocated that spectrum and wireless systems won’t be allowed. And to make matters even more confusing to the little guy, it’s all based on Broadcast Television channels, channels 52 – 69. Take a listen.

So what do we do about it? If you have a professional sound person, most likely, nothing, they’ve got it handled. But if you don’t, that’s what this episode of With A Voice Like This is all about.

Dave Kusek

This episode of With A Voice Like This I’m speaking with Dave Kusek, co-author of the book The Future of Music: Manifesto for the Digital Music Revolution.

It’s been four years since the book came out and this show starts with what has changed and what has stayed the same since the book was published. But there’s a twist. At the beginning of the show I asked that we not focus on the technology itself for the entire interview, since the book had so much more to offer than just a discussion of technology. This is a quick show, recorded early because I’m on my way to my first meeting as a member of the Chicago Music Commission’s Advisory Board.

This  episode is a quick recap of just a few things that happened today and a little earlier in the week. It was a head-spinning day, so here’s what I talked about:

The second site is MixMatchMusic.com, which is taking a new approach to the musician community which allows for collaboration with other musicians, get new listeners and allow for anyone to remix all while making sure the musicians are paid for their work. Looking Ahead
Next week will be a special show since I’ll have Paul Natkin the Interim Executive Director of the Chicago Music Commission as a guest. We will be discussing the Event Promoter Ordinance I first talked about in Episode 054 – The City of Chicago vs. Live Music. The Chicago Music Commission is a charitable organization (501(c)3) that first discovered the proposed ordinance and brought it to the attention of the music community and public at large and is now working with the city on this ordinance. I’ve been practicing writing press releases after reading a section of the book Promoting Your Podcast by Jason Van Orden and run through the standard format of a press release, what needs to go into a good press release, how to structure the writing and where and when it should be sent. I used the blog entry How to Write a Press Release to help illustrate the points.

At Any Rate
This episode’s At Any Rate was a lot of fun for me, since I got to play some of the new Demo clips that are going up on the 4-AM website. Those include Rhumba Girl, Too Late Now and I Remember You. I also played a snippet from an arrangement I’m working on of Follow Me, by Uncle Kracker.

Before I got into the topics at hand on this episode of With A Voice Like This, I talked briefly about the why the last show being cancelled because of a tornado that went through NW Indiana and a picture some of the podcast gallery had seen and I put the link in the show, here’s a link to the picture I took:

4-AM
With one of the group being out of town for a bit, it gives us a chance to look at both legacy media and new media with 4-AM. Taking a look at BlogCatalog and its submission and approval practices. Working to get more clips out on the blog/website and looking to schedule a photoshoot as soon as possible and working on more arrangements for the group with rehearsal cuts.

Talking about the upcoming gigs for 4-AM, the Podcast Gallery asked if all the gigs were paid and that lead to a discussion about the value of doing free gigs and how we decide as a group to do something for free. Then a discussion about motivations for doing what I do specifically with my music and is it happening fast enough for me. I may be using a Mac? Yes, I could possibly be  getting back to a being a cross-platform person with the addition of a MAC G4 Cube  as a gigging computer.

Building relationships with venues by having press available for them and then linking to them through the gigs page to include pricing, location info and build audience. We want to get invited back to the venue. Building that good reputation for both the group and the venue by combining all the information into easy to access clicks. And build a little by having a different performance the night before, you can’t beat it when you’ve got a quality performance at a quality venue.

This is the site where my Christmas EP With A Voice Like This Christmas was being offered as a Disc on Demand and the ideas of how to offer the EP for the upcoming Christmas season, so stay tuned on that one. as long as there is an interest, I’ll make sure that The EP will be available.

4-AM (00:04:49)
The two day, twelve hours recording sessions in which we recorded 9 (I could only remember 8 of the titles) songs for our demos and woodshedding purposes. The majority will end up with 30 second excerpts on the site to give site visitors an idea of our repertoire and style. Also discussed was how we decide on the songs we do, what media players are available for the websites (see the links below) and how to know when and where we’ll be performing.

This episode takes a look at a tool I had seen trumpeted as a “copyright infringement assessment tool” PDTool, why I think it’s not a good tool and some much better alternatives for dealing with copyright infringement assessment as a new media person, Public Domain Music and the Podcasting Legal Guide.

This episode was also the official launch announcement of for http://4-AM.net, the official website for our a cappella group. A quick trip through the site, which took until the last minute before the show to get loaded (Ah the joys of downloading program patches when an app fails and conversion times) and it was ready to go by show time. At Any Rate (00:06:20)

MyAWOL – An upcoming web 2.0 service you might want to know about and watch (it’s an acronym for My Artists WithOut Labels). It’s going to be part Music database (to launch within the next month or so), part online music community for unsigned artists, part indie label, part online venue and more. That’s a tall order to fill, and it will be interesting to see how it all shakes out. I reference a TechCrunch Article and a Digital Music News Article to give as much information as possible.

Last.fm and Merlin – It would seem that Last.fm’s issues aren’t over after the fallout with Warner Music. according to the Hypebot.com Article and The Register Article, The global indie rights organization is stalled in certains aspects of their talks with last.fm and is warning its membership about the agreement currently in place. While this is to be expected when defining and redefining new delivery methods and revenue streams, among other things, there seems to be a of old school issues and mindsets on both sides here. There is a huge opportunity here, let’s see how it’s embraced. There’s probably another post in here somwhere as well.

I take a look at the Judges’ ruling made Thursday in Viacomm’s suit against Google which instructs Google to turn over approximately 12 terrabytes of YouTube data to Viacomm, including Login IDs and IP addresses of users. People have issue with the case itself, but it’s to be expected that Corporate representatives of traditional media and the Internet go head to head to help definewhat’s allowable and what isn’t. Is the customer’s loss of privacy acceptable collateral damage in the court battle?

4-AM update (00:09:00)
There was a lot to talk about again this episode regarding 4-AM, the group and the website. So I talked about a lot of the work I’ve done on stage.4-am.net before go live. Plugins galore, starting with the Search Engine Optimization plugin in All in One SEO Pack and all that’s gone into that. Then the new tiltviewer Photo Gallery using both the NextGEN Gallery and NextGEN FlashViewer plugins, which are great and you need to see what you can do with them using your own flickr account. Amazing.

Then a quick discussion of what’s happening with the group, a new business direction and of course another new arrangement we did. This week’s was the Supremes’ Come See About Me. And we’re getting closer to a gig where we can do a live video stream so you all can see what 4-AM is all about.

There was a lot to talk about here. Where the website is at, a new way of working up arrangements for the group, starting with the song Mama Told Me Not to Come and some of the fun things that happened with that. We also had a good talk about where we’re heading and what our focus is and I got the opportunity to show them how video streaming works on the web briefly.

Spain’s Digital Canon [00:17:00]
Yes, this is a further discussion about the new anti-piracy tax that Spain is instituting on July 1. It’s more in depth looking at possible reasons for Spain implementing it and what seems to be some of the pitfalls of the tax itself. I also got some feedback regarding Canada’s anti-piracy tariff. There are some interesting thoughts there. I’d love to hear some of your thoughts on what was said.

Note: The day after I recorded this show, Gerd Leonhard released a post with video about the future of copyright. It’s very much worth a look and it’s nice to see that there are people out there who see that Copyrights still have their place, in a new form of course, but not throwing out all the protections with new technology. Another thing I think that the Copyrights would be useful for is a transistion framework, at least as they apply here in the U.S. Ah, what I wouldn’t give to have Gerd Leonhard on the show, I’d have a lot of things to ask and say.

Music and the Internet is a Virtual Venue

• Performers perform (Streaming)
• Consumers pay (e.g. cover charge, all inclusive charge)
• Consumers can also buy recordings and other merchandise above entrance fees
• Venues (ISPs,  applications) are responsible for reporting and payment

Database

• With new code, all streams, downloads, etc. are tracked and put in a database (Who holds the DB TBD)
• No more sampling needed, just a direct pull of tracks from the database

Collecting

• Performance Rights Organizations (PRO) could still collect, but pay based on actual numbers, not samplings
• No PRO could collect for non-members and keep money if the performers either don’t join, can’t be found or don’t claim their money
• Artists, Authors, Lyricists and Publishers responsibility is to secure a code so they are credited and paid for their works or not paid by their choice.
• Any music without the code is flagged in database and action taken (example of software recognition at EveryZing.com)

The Down side

This discussion is an overly simplistic layout of a very complex idea. Currently the Orphan Works Act almost passed in Congress and it seems very similar to what I’ve outlined here. You can hear it discussed at great length on Webcomics Weekly #38 from a visual artist’s point of view and its major weaknesses. I feel I’ve taken some of the things into account that were ignored in the Orphan Works Act and although not exactly the same, the pitfalls could be very similar.

Technique is the Servant of Communication

In this episode and the first half of the interview, I speak with Gillian about her training, past experiences and what brought her to the point of starting VoiceQuest Inc. 12:45pm Well, as promised, I’m making this entry from the road on my way to Luxemburg, WI to play at the Northbrook Country Club tonight.

I’m starting to see the results of some of timing of the project and how some of my choices are working out. 2:27 pm Out of the six songs I’ve recorded, three are getting ‘airplay’ on podcasts, with Deck the Halls being the most played, followed by both We Three Kings and The Coventry Carol. 3:05 pm I thought that We Three Kings would have been the one to be played the most, but it really doesn’t make much difference which song is being played the most as long as they’re being played, right? And the fact that half of the songs that are available are being played means that the songs are appealing to a wide variety of tastes, which is a great thing. And I get feedback, like Molly’s comment on the podcast. you just can’t beat good planning.

A lot of things have lined up for today and I would be totally remiss not to take advantage of it and let it help fuel what I’m doing. First, the date, it’s December 1st (and a Saturday, bonus!). For some purists, this is the first allowable day to play Christmas music, so there will be an increase of web surfing for Holiday music. Second, I have three finished pieces that I can put on the site to show it’s more than just a one shot CD and Third, I have a commercially acceptable song in We Three Kings. The time to strike is here and let what I’ve done stand on its own two feet and power the rest of the project as well.

So off I go to SellMusicDirect.com to upload the music. Since I haven’t said anything since the beginning about this, I’ll recap a little. I have a PRO account with SellMusicDirect.com. This means I can put up to 6 CD projects in this account and they will not only sell downloads, but will also manufacture CDs on demand, as long as I’ve put together the CD and artwork. That way I can sell the CD without having to carry a minimum amount of inventory. Great deal for what I’m doing. I go into my account and start to set it up to sell The songs and I’m met with a Genre list that I classify the song. I was working first on We Three Kings and this is the list that I got:

Now there’s no Holiday genre and no A cappella genre, so the question becomes, what genre do I use? From what I’ve seen, most a cappella music usually get put in the jazz genre because the industry doesn’t seem to know what to do with it, so I’ll put it in Smooth Jazz. We’ll see how that goes, if I get any feedback based on a miscategorization. I also chose to have it listed as podsafe, though I may go back and change after rereading what the site’s definition of podsafe is. So now it’s out as a downloadable single at BuyMusicDirect.com, as well as Christmas Angel and A Round For the Holidays.

First Caroling gig of the season, the idea of a “Gig Map” for this blog where I’m appearing and here’s the Coder’s challenge:

Using the Google Maps API and an XML file ( basically, an adapted KML file) that would list the gig’s information in a chronological order with aging map markers and a indicator of some type of whether the gig was a public gig or a private gig, with these parameters.

• A much better way to lay down tracks that makes it easier for me to sing
• A way of being able to do post production that makes sense to me
• A way to remix the song A Round for the Holidays
• A computer issue I get to work out or see if it simply disappears (not a bad thing, just something to be done)
• Some advice on how to resolve the issue and keep it from happening again
• A renewed appreciation of equipment that works with no issues
• Resolved the memory issue with my computer from yesterday
• An interview tomorrow night on the Indigo Room: Creating Our Reality

Well, I got my memory issue resolved… Yay! Now to tackle the sound quality issue that developed as well. I talk about the frustrations of that and everything I tried to resolve it.
